This Privacy Policy describes how Neurowellness ("we," "us," or "our") collects, uses, and discloses information from and about you when you use our mobile application and related services (collectively, the "Service"). We are committed to protecting your privacy and handling your data in a transparent and secure manner, especially given the sensitive nature of the information we collect.

By using the Neurowellness app (hereafter; App or app), you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Service.

1. Information We Collect

We collect information to provide, improve, and secure our Service. Your health data remains on your device at all times, unless otherwise specified.

a. Information You Provide Directly:

• Account Information: When you create a Neurowellness account, we collect your email address. This is used for login, password recovery, and communication.
• Payment Information: When you subscribe to our Service, payment details are processed by our third-party payment processor, Stripe. We do not directly collect or store your full payment card information. Stripe provides us with limited transaction information, such as the type of card used and the last four digits, to confirm your payment. Stripe has its own privacy policy that governs the collection and use of your payment data.
• Remarks: Account Information and limited Payment Information are stored on our servers or with secure third-party processors and are transmitted via the internet to our servers or third party cloud services.
• Health and Wellness Information: The core of our Service is the collection of electroencephalography (EEG) data. This is considered sensitive health-related data. When you use the Brainbit EEG device with our app, we collect and process the following data:
  • Raw EEG signals
  • Derived brainwave metrics (delta, theta, alpha, beta, gamma wave power)
  • Session logs, including duration and progress tracking
• Remarks: Health and Wellness Information is stored exclusively on the device. This data is NOT transmitted via the internet to, or stored on, our servers or any third-party cloud services. All health and wellness data is governed by the terms & conditions that you agreed on when using this service. While the data is processed using current local-only architecture, any future cloud-based data handling will be subject to updated user consent and revised privacy documentation.

b. Information Collected Automatically:

• Log Data: In the event when you log on your device using account credentials, we and our third-party services may have access to information such as your device's IP address, device name, operating system version, app configuration, and the time and date of your use of the Service. This information may be used to calculate app usage, functionality, and errors occurring at the user or backend.

2. How We Use Your Information

• To Provide and Maintain the Service: operate core functions including processing neurofeedback sessions and providing real-time feedback.
• To Process Subscriptions: manage subscriptions and process payments through Stripe or other third-party payment services.
• To Communicate with You: send service-related communications such as account updates, password reset links, and subscription info.
• To Improve Our Service: analyze usage patterns, diagnose technical issues, and develop new features.

3. Data Sharing and Disclosure

We will not sell, rent, or share your personal information with third parties for their marketing purposes. We may, however, share your information in the following circumstances:

• With Your Consent: We may share your data if you give explicit permission.
• Third-Party Service Providers: We use trusted third-party companies and individuals to facilitate our Service, such as payment processing (Stripe) and analytics (Google, Apple). These parties have access to your personal information only to perform tasks on our behalf and are obligated not to disclose or use it for other purposes.
• Legal Requirements: We may disclose your information if required by law or to protect rights, property, or safety.
• Business Transfers: If we are involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction.

4. Your Control Over Your Data

• Access and Correction: You may request to access and correct any inaccuracies in your personal information.
• Data Deletion: You may request deletion of your account and associated personal data. Our database administrator will delete your account information including email and metadata. As all sensitive health data is stored exclusively on your device, we do not have a copy to delete.
• Opt-Out: You may opt out of receiving certain non-essential communications, and all reasonable requests will be processed in accordance with applicable law.

5. Data Retention

We retain your personal data for as long as necessary to provide the Service, fulfill the purposes outlined in this policy, and comply with legal obligations. Once data is no longer necessary, we will securely delete or anonymize it.

6. Security

We are committed to protecting your data using commercially acceptable measures. However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of any data transmitted to or from the App or stored within its systems, and you assume all risk for unauthorized access, loss, corruption, or disclosure.

7. Children's Privacy

Our Service is not intended for anyone under 18. We do not knowingly collect personal information from children under 18. If we learn that a child under 18 has provided personal information, we will delete it from our servers.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this policy periodically.
